Withdrawal Policy

1. Right of withdrawal

Consumers have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us

by means of a clear declaration (e.g. a letter or e-mail) of your decision to withdraw from this contract. You may use the model withdrawal form below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notification of exercising the right of withdrawal before the withdrawal period expires.

2. Consequences of withdrawal

If you withdraw from this contract, we must repay all payments we have received from you, including delivery costs (if any), without undue delay and at the latest within fourteen days from the day on which we received notification of your withdrawal. For this repayment we generally use the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; you will not be charged any fees for this repayment.

If, in the case of a rental licence, you requested that performance begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract (details in section 3a).

For contracts on digital content that is not supplied on a tangible medium, however, the right of withdrawal may expire early under the conditions set out below.

3. Early expiry for digital content

For digital content that is not supplied on a tangible medium, the right of withdrawal expires early if we have begun performing the contract after you have expressly consented to us beginning performance before the withdrawal period expires and you have confirmed your awareness that you lose your right of withdrawal by giving this consent, and we have provided you with a confirmation of the contract on a durable medium recording your consent and confirmation (Section 356 (5) and Section 312f of the German Civil Code, BGB). We send you this contract confirmation by e-mail to the address provided at checkout once payment has been received; it also contains this withdrawal policy and our terms.

At bspmarket.de this concerns in particular the immediate download or immediate unlocking of digital maps, BSP files, assets, download packages or comparable digital content. If you confirm immediate performance during checkout or before the download is provided, and the digital content is then provided, your right of withdrawal may expire upon provision.

3a. Server-Exclusive licences and rental licences

One-time licence: A Server-Exclusive licence against a single payment is a contract on digital content that is not supplied on a tangible medium. Section 3 applies to it. You give the consent and confirmation at checkout via the checkbox on the right of withdrawal. We begin performing the contract as soon as we generate your individual licence package after receipt of payment; subject to the conditions of section 3, your right of withdrawal expires at that time.

Rental licence: A rental licence is a contract under which we continuously provide you with the Server-Exclusive licence, including the online licence check, for the duration of the subscription. The rules on services apply to this contract: the right of withdrawal does not already expire upon provision of the licence package, but only once we have fully performed the service after you have expressly requested that we begin performance before the withdrawal period expires and have confirmed your awareness that your right of withdrawal expires upon full performance of the contract (Section 356 (4) BGB). You can therefore withdraw from the rental licence within the withdrawal period of fourteen days from conclusion of the contract.

You give the express request and the confirmation in the rental dialog via the checkbox on the right of withdrawal. If you subsequently withdraw, we will refund the amounts paid less a pro-rata amount for the period from the start of the rental until receipt of your withdrawal (compensation under Section 357a (2) BGB, section 2). The basis is the monthly price of the first billing period, pro rata by days. The withdrawal ends the subscription and the licence is blocked. Without such an express request, you do not owe any compensation.

Irrespective of the right of withdrawal, you can cancel the rental licence at any time with effect from the end of the current billing period (section 9a of the Terms).

4. No exclusion of statutory warranty rights

The expiry of the right of withdrawal does not mean that statutory rights regarding defective digital content are excluded. If digital content is not provided, does not work, deviates significantly from the description or is otherwise defective, you may be entitled to statutory warranty rights.
